SMS Messaging Terms

1. Program Description
Élévatione West Palm Beach (operated by South Beach Cosmetics LLC, "we," "us," or "our") operates an SMS messaging program ("the SMS Program") that delivers transactional and promotional text messages to consenting subscribers in the United States. By providing your mobile phone number and expressly opting in via our SMS opt-in form, our chat widget, our appointment booking system, or in-spa intake forms, you agree to these SMS Terms and Conditions.
2. Consent
By providing your mobile number and affirmatively opting in, you expressly consent to receive automated SMS text messages from Élévatione West Palm Beach at the number provided. Consent is not a condition of purchase of any product or service.
Opt-in occurs only via:
- Web form submission at /sms-opt-in.html with explicit consent checkbox
- Appointment booking through our website or third-party booking widget where SMS consent is explicitly captured
- In-person intake at our spa with signed written consent
- Customer-initiated chat session via our website chat widget where consent language is presented and acknowledged
3. Message Types You May Receive
- Appointment reminders: Sent ~24 hours before scheduled treatments
- Booking confirmations: Immediate confirmation when appointments are scheduled or rescheduled
- Promotional offers: Special offers on treatments, devices, packages, and memberships
- Account notifications: Payment confirmations, financing updates (Affirm), order status
- Customer service: Responses to your inquiries and follow-up
4. Message Frequency
You will receive approximately 2 to 6 messages per month. Actual frequency depends on your account activity, booked appointments, and the time of year. Frequency may increase during seasonal promotions or in response to your inquiries.
5. Message and Data Rates
Message and data rates may apply as determined by your mobile carrier. Élévatione West Palm Beach is not responsible for any charges incurred from your wireless carrier. Please check with your carrier for details about your messaging plan.
6. How to Opt Out (STOP)
Text STOP to opt out. You may opt out of the SMS Program at any time by replying STOP (or texting STOP, END, CANCEL, UNSUBSCRIBE, or QUIT) to any message you receive from us. To stop receiving messages, reply STOP to any text message. After replying STOP, you will receive one final confirmation message and will not receive any further SMS messages from the Program.
To rejoin after opting out, you may text START or UNSTOP to the number that previously messaged you, or re-submit our opt-in form.

8. Carriers Supported
Our SMS Program is supported on major U.S. mobile carriers including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.
9. Eligibility
The SMS Program is available only to individuals who are at least 18 years of age and reside in the United States. By opting in, you represent and warrant that you meet these eligibility requirements and that you are the authorized user of the mobile number you provide.
10. Privacy
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We do not sell, rent, or share your SMS opt-in data or consent information. Your mobile number and consent record are used solely to deliver the messages described in this program.

11. Changes to These Terms
We reserve the right to modify these SMS Terms and Conditions at any time. We will notify subscribers of material changes by SMS or email at least 7 days before changes take effect. Continued use of the SMS Program after changes constitutes acceptance of the modified terms.
